I usually spend some time every day at my San Francisco Bay Area immigration law office making inquires on pending cases. It is a frustrating process because I rarely receive answers and when I do, they usually are not helpful.
United States Citizenship and Immigration Services ("USCIS") has recently released guidance on how to make inquiries at their Service Centers (http://www.californiaimmigrationlawyerblog.com/USCIS%20update.pdf). They provide a three step process. The first step is to call their National Customer Service Center at 1-800-375-5283. If the issue is not resolved in 30 days, you proceed on to the next step which is to email the USCIS Service Center where your case is pending. The email addresses are:
California Service Center csc-ncsc-followup@dhs.gov Vermont Service Center vsc.ncscfollowup@dhs.gov Nebraska Service Center ncscfollowup.nsc@dhs.gov Texas Service Center tsc.ncscfollowup@dhs.gov (tsc.ncsfollowup@dhs.gov)
If there is no response to the email, you proceed to the last step which is to notify the USCIS Headquarters office of Service Center Operations by email at SCOPSSCATA@dhs.gov. The notice indicates that you will receive a response from this email within ten days.
It remains to be seen whether this system actually works. I will try it out in a few cases and will report back what happens.

Good to see motivated members.....
It is certain that the politicians will not touch the immigration topic in the next one year. Even after best efforts of the president the immigration bill failed in the senate few months ago.
One and only one thing that can be tried before Nov 2008 is the recapture of visa numbers from the last five years. I think IV should push for that.
Other than the above not much can happen, get ready for really long cold winter and then a looong hot summer. I wish things were better.

Hi ,
I'm on H1B. Recently I joined new employer and the transfer is still in
pending status.
Among the documents required to sponsor for B2 visa, I'm supposed to
send copies of I-797 and I-94. I have old employers H1B approval notice
and I-94, but not of the new employers. I have the H1B receipt notice
related to the new employer.
Is it fine to sponsor for a B2 visa and for the visitors to attend the visa
interview in the US consulate with all the other essential documents
including new employers H1B receipt notice without the new employer H1B
approval notice.
Any of your valuable suggestions are welcome.

Has anyone tried to talk to your banks for refinance under this new rule? I talked to my bank- Wells Fargo..They were very rude and said that they do not know about this at all as they haven't got any notification.When I told them that this news is on CNBC...they did not want to believe it.Asked when I should call again,they said keep calling every week..Was really disappointing...

The American Immigration Policy Center issued an excellent Fact Sheet about H2A farm orkers and the need for reform.
The Agricultural Job Opportunities, Benefits, and Security (AgJOBS) Act has long served as a blueprint for comprehensive immigration reform. AgJOBS, which combines an earned legalization program for farmworkers with a reform of the H-2A temporary foreign agricultural worker program demonstrates a successful model for compromise where workers and employers have come together to resolve their differences. The dysfunctional U.S. immigration system is currently standing in the way of addressing deeper structural problems that impact U.S. workers and U.S. competitiveness in a globalized market. As Congress proceeds, here are a few facts about the current challenges at the intersection of immigration policy and agriculture, and why addressing these issues is critical to the nation�s economy.
Here is an interesting fact :Most farmworkers are not authorized to work legally in the U.S.
According to the National Agricultural Workers Survey (NAWS), conducted biannually by the Department of Labor, the share of seasonal agricultural workers who reported that they were unauthorized has increased dramatically in the last two decades, rising from 7% in Fiscal Year (FY) 1989, to 16% in FY 1990-91, to 28% in FY 1992-93. In the most recently published NAWS survey from FY 2001-02, 53% of all seasonal agricultural workers admitted they were not authorized to work in the U.S. However, many experts suggest that the number may actually be closer to 75%.

Hi,
I have a question regarding Priority Date Re-capture. When a new I-140 is filed requesting priority date re-capture from the old I-140, what happens to the old I-140. I hope the old I-140 is not cancelled. The reason I ask is, if the new I-140 runs into any issues, I don't want to lose the old I-140 as well. Thanks.

That's why you get up at 4:30! My friends make fun of me for that... The successive ridgelines in the fog make for a real feeling of depth. I've tried that technique a few times, but never pulled it off this well. I also like the aspect ratio you chose, it contributes to the 3-D, receeding-to-a-point, effect. The color here is likewise very nice. The only thing I would say could be better is that the sun is distorted by the cloudline. It would be better if totally obscured, or better resolved. In any case, you can't control the clouds. Super shot.

To best of my knowledge, a person on EAD (probably not the primary candidate) can work for anyone.. It can be City, State, Federal or McDonald's at any position, part time or full time, provided the job does not involve any government classified information. Jobs involving classified information are only for citizens that too after proper background check.
Primary candidate might work for the government i.e. if job requires skills that citizens don't have and that group has a policy of filing H1's..

I had filed my 485 during the VB fiasco, but did not file for ead/ap, as my H1 was valid. I intend to apply now but not sure what the filing fee is? Can one of you guys who might have filed later guide me on what the fee amount is and the documents that need to go with it. Is Efiling an option?
USCIS website says $340 for the EAD and $304 for AP, but I guess it is the new fee and does not apply to folks who had their AOS filed before July 30, 07.

1. I need advice as to how to withdraw the I-485 AOS application. I do no have copy of documents/notices that USCIS sent.They are with my wife.

2. If we do work out our differences then is there a way to keep the current AOS alive? Or shall I get the current one withdrawn and file for a new one if we do resolves our differences?

Sorry about your marriage problems. If there is a chance that you might be able to work things out, I suggest rescheduling the 485 interview. If you even have the interview letter, then you should have the receipt number and your A# that can be used to track the file. You can also use these to withdraw the 485 if you need to.

This is pretty confusing to me as to what I am can and cannot do with an EAD/AP combination. Right now I am on an H1-B visa. What are the major differences from getting a green card, other than the fact that if the green card is rejected for some reason, I would have to leave the country For example, on EAD/AP, can I:
1. Quit my current job and sit at home, and do nothing?
2. Start a company?
3. Go to Full time MBA school?
4. Go to part time MBA school with my current job?
5. Switch jobs as many times as I want using AC21?
